Scope (of a document)

Accommodation contracts and related agreements entered into by this facility with guests shall be in accordance with the provisions of these General Accommodation Terms and Conditions, and any matters not provided for in these General Accommodation Terms and Conditions shall be in accordance with laws and regulations or generally established customs.

In the event that this facility agrees to a special agreement to the extent that it does not contravene laws, regulations, and custom, such special agreement shall prevail notwithstanding the provisions of the preceding paragraph.

Application for Accommodation Contract

Article 2 A person who wishes to apply for an accommodation contract at this facility shall provide the following items to us.
(1) Name of the lodger
(2) Date of stay and estimated time of arrival
(3) Accommodation charge
(4) Other items deemed necessary by the facility.
In the event that the guest requests to continue his/her stay beyond the date of stay stipulated in item 2 of the preceding paragraph during his/her stay, the facility shall treat such request as a new application for a contract of accommodation at the time such request is made.

Formation of Accommodation Contract, etc.

Article 3 The accommodation contract shall be concluded when this facility has accepted the application as described in the preceding article. However, this shall not apply when the facility proves that it did not give its consent.

When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, the accommodation charge for the period of stay shall be paid by the date designated by the facility. The deposit shall first be appropriated to the accommodation charge ultimately payable by the guest, and if a situation arises in which the provisions of Articles 6 and 17 apply, the deposit shall be appropriated in the order of penalty followed by compensation, and any remaining amount shall be returned upon payment of the charge in accordance with Article 12. In the event that the application fee stipulated in Paragraph 2 is not paid by the date designated by the facility in accordance with the provisions of the same paragraph, the accommodation contract shall cease to be effective. However, this shall apply only in the event that this facility has notified the guest to that effect when designating the date for payment of the application fee.

Covenant not to require the payment of an application fee

Article 4 Notwithstanding the provisions of Paragraph 2 of the preceding article, this facility may accept a special agreement not to require payment of the application deposit as specified in the same paragraph after the contract is concluded. In the event that this facility does not require payment of the application fee as stipulated in Paragraph 2 of the preceding article or does not specify the date for payment of said application fee when accepting an application for an accommodation contract, this facility shall be deemed to have accepted the special contract stipulated in the preceding paragraph.

Refusal to enter into an accommodation agreement

Article 5 The facility may refuse to enter into an accommodation contract in the following cases
(1) When the application for accommodation is not in accordance with these clauses.
(2) When there is no room available due to full occupancy.
(3) When it is recognized that the person seeking accommodation is likely to conduct himself/herself in a manner contrary to the provisions of law, public order, or good morals in connection with the accommodation.
(4) When it is recognized that the person who intends to stay falls under any of the following items (a) through (c).
A. When there is a risk that the person who intends to stay in the room may fall under any of the following items Boryokudan as defined in Article 2, Item 2 of the Law Concerning Prevention of Unjust Acts by Organized Crime Groups (Law No. 77, 1991) (hereinafter referred to as “Boryokudan”), Boryokudan members as defined in Article 2, Item 6 of the same law (hereinafter referred to as “Boryokudanin”), quasi-organized crime group members or persons related to Boryokudan or other anti-social forces
B. Boryokudan or Boryokudan-involved persons or other organizations whose business activities are controlled by Boryokudan or Boryokudan-involved persons
C. A juridical person of which any of its officers falls under the category of Bouryokudan-in (Boryokudan Member)
(5) When a person seeking accommodation has said or done something that causes significant inconvenience to other guests or residents in the neighborhood.
(6) When the person seeking accommodation is clearly recognized as a person with an infectious disease.
(7) When a violent demand is made with regard to the accommodation, or when a burden exceeding a reasonable range is demanded.
(8) When the hotel is unable to accommodate the guest due to a natural disaster, a breakdown of the facilities, or other unavoidable reasons.
(9) When the accommodation falls under the grounds for refusal of accommodation as stipulated by various laws and regulations or prefectural ordinances, etc.

Guest’s right to cancel the contract

Article 6 The guest may cancel the accommodation contract by notifying this facility.

In the event that the accommodation contract is cancelled in whole or in part for reasons attributable to the accommodation guest (except in the event that this facility specifies the due date for payment of the application deposit and requires payment thereof pursuant to Article 3, paragraph 2, and the accommodation guest cancels the accommodation contract prior to such payment), this facility shall charge a penalty as determined by this facility. ), a penalty charge as determined by this facility will be applied. However, in the event that this facility accepts the special contract stipulated in Article 4, Paragraph 1, this will be limited to when this facility has notified the guest of the obligation to pay the penalty when the guest cancels the accommodation contract in accepting the special contract. In the event that the guest does not arrive at 10:00 p.m. on the day of the stay (or the estimated time of arrival, if such time has been indicated in advance) without making contact, this facility may deem the accommodation contract to have been cancelled by the guest and process the situation as such.

Right to terminate the contract of this facility

Article 7 The facility may cancel the accommodation contract in the following cases
(1) When it is recognized that the guest is likely to commit an act contrary to the provisions of law, public order, or good morals in connection with the accommodation, or when it is recognized that the guest has committed such an act.
(2) When it is recognized that the lodger falls under any of the following (a) through (c)
A. Boryokudan (organized crime groups), Boryokudan members, quasi-constituents of Boryokudan, or persons related to Boryokudan, or other anti-social forces
B. When the guest is a Boryokudan or a juridical person or other organization whose business activities are controlled by Boryokudan or Boryokudan-affiliated persons
C. A juridical person, any of whose officers falls under the category of Bouryokudan-in (organized crime group) member
(3) When a guest uses language or conduct that causes significant inconvenience to other guests or neighboring residents
(4) When a guest is clearly recognized as a person with a contagious disease.
(5) When a violent demand is made with regard to the accommodation, or when a burden exceeding a reasonable range is demanded.
(6) When the hotel is unable to accommodate the guest due to a force majeure such as a natural disaster.
(7) When the accommodation falls under the grounds for refusal of accommodation as stipulated by various laws and regulations or prefectural ordinances.
(8) When the guest does not comply with the prohibition of smoking in the sleeping room, tampering with fire fighting equipment, or other prohibited acts (limited to what is necessary for fire prevention) in the rules of use established by the facility. (9) When a guest does not comply with the rules and regulations of the facility (limited to those necessary for fire prevention).
When this facility cancels the accommodation contract pursuant to the preceding paragraph, no charge will be made for accommodation services, etc. that have not yet been provided to the guest.

Lodging Registration

Article 8 Guests shall register the following items at the cashier’s counter of this facility on the day of their stay.
(1) Name, age, sex, address and occupation of the guest
(2) In the case of a foreigner, nationality, passport number, place of entry and date of entry
(3) Date and scheduled time of departure
(4) Any other matters deemed necessary by the facility.
If the guest intends to pay the charges as specified in Article 12 by a traveler’s check, hotel voucher, credit card, or any other method that can be substituted for currency, the guest shall present them in advance at the time of registration as specified in the preceding paragraph.

Room Usage Hours

Article 9 Guests may use the rooms of the facility from the check-in time to the check-out time as determined by the facility. However, in the case of a consecutive stay, the guest may use the room for the entire day, except for the day of arrival and the day of departure.
Notwithstanding the provisions of the preceding paragraph, the facility may accept the use of a guest room outside the hours specified in the preceding paragraph. In such cases, the facility will clearly inform the guest in advance of the amount of the additional charge, and the guest will be charged for such additional charge.

Compliance with Rules of Use

Guests shall follow the rules of use established and posted by us at the facility.

Business Hours

Article 11. Business hours of the facility shall be as follows
(1) Office hours: 9:30-18:30
(2) Check-in 15:00-18:00
(3) Check-out 9:30 – 11:00
*The hours in the preceding paragraph may be changed temporarily in case of unavoidable circumstances. In such a case, the hotel will notify the guests by an appropriate method.

Payment of Fees

Article 12. The breakdown of accommodation charges, etc. payable by the guest and the method of calculation thereof shall be in accordance with the rules of this facility.

Payment of the accommodation charges, etc. set forth in the preceding paragraph shall be made when requested by this facility, in currency or by a method acceptable to this facility, such as a traveler’s check, room voucher, credit card, etc., which can be substituted for such payment.
The accommodation charge shall be charged even if the guest voluntarily does not stay in the room after the facility has provided the room to the guest and made it available for his/her use.

Responsibility of this facility

Article 13. The facility shall compensate for any damage caused to the guest in the performance of the accommodation contract and related agreements, or in the event of non-fulfillment of such agreements. However, this shall not apply when the damage is not caused by reasons attributable to the facility.
This facility has Ryokan liability insurance in case of fire, etc.

Handling of cases where the contracted room cannot be provided

Article 14. In the event that this facility is unable to provide the guest with the contracted room, this facility shall, with the consent of the guest, arrange for other accommodations under the same conditions as far as possible.

If, notwithstanding the provisions of the preceding paragraph, this facility is unable to find other accommodation, it shall pay the guest a compensation fee equivalent to the amount of the penalty charge, and the compensation fee shall be applied to the amount of compensation for damages. However, if there is no reason attributable to this facility for not being able to provide the guest room, no compensation fee will be paid.

Handling of Deposited Items, etc.

Article 15. In the event of loss, damage, or other loss of or damage to articles deposited by guests at the facility, compensation shall be made in accordance with the provisions of the Commercial Code and in accordance with the terms and conditions of the insurance policy provided by the facility, except in the case of a force majeure event. No cash or valuables will be accepted.

The facility shall not be responsible for any loss, damage, or other loss of or damage to any items, cash, or valuables brought into the facility by the guest. However, in the event of loss or damage due to malicious intent or gross negligence on the part of our facility, we will compensate for the loss or damage in accordance with the terms and conditions of the insurance policy we have in place.

Storage of baggage or personal belongings of guests

Article 16. In the event that a guest’s baggage arrives at this facility prior to his/her stay, the facility shall responsibly keep it and hand it over to the guest when he/she checks in, provided that the facility understands this prior to his/her arrival.

In the event that a guest’s baggage or personal belongings are left at this facility after the guest has checked out, and the owner is found, this facility shall contact the owner and request instructions from him or her. However, if the owner’s instruction is not given, or if the owner is not known, the property will keep the baggage for 7 days including the day of discovery, and then report it to the nearest police station.

Guest Responsibility

Article 17. In the event that this facility suffers damages due to the intentional or negligent act of a guest, said guest shall compensate this facility for such damages.

If a guest smokes outside of the smoking area in the facility, 50,000 yen will be charged as a cleaning fee.

If a guest uses fireworks other than the hand-held fireworks specified by the facility, the guest will be charged 50,000 yen as a nuisance fee. In addition, if any damage is caused to the facility, exterior, or lawn by the use of fireworks outside of the permitted area, the guest will be charged for the cost of repairing the damage.
